Terms and Conditions
About:
The following words and phrases are to be defined as the following: Company”: Greenhopper Machineries & Contractors Pvt Ltd a company registered in Kerala, India under the company number . The registered office is at SIDCO Industrial Estate, Kallettumkara, Thrissur,(A SIDCO registered Organisation (Govt. of Kerala Undertaking)) which is also the main trading address. The company is not known by any other name, Contract”: this is any contract between the Company and the Customer for the sale and purchase of all Goods incorporated within the conditions applied. “Customer”: the company, firm or individual who agrees to buy the Goods from the Company. Delivery Point”: the location for delivery of the Goods specified in the Company’s quotation, order confirmation or as instructed by the Customer at the point of order. “Price”: the agreed purchase price for the Goods as stated in the Company’s quotation or order confirmation. “Special Purchase Goods”: Goods that are sourced or modified specifically for the Customer by others.
Prices:
Any quotation given by the Company is valid for 10 days. Packaging and delivery, which shall be charged in addition at the Company’s prevailing rates at the time of acceptance of order. Any other customs duty or tax which may be added as required by rules or regulations currently in force, which shall be paid in addition at the rate prevailing on the date of the invoice. The Company reserves the right to make an additional charge in respect of preparation of working drawings or designs which are necessary for processing the Customer’s order or are requested by the Customer including, but not limited to, drawings for use by the Customer in connection with other associated building work or trades. The Customer shall have no right of cancellation by virtue of the increase in the Price in accordance with Condition. Such right of cancellation shall be the only remedy available to the Customer and the Company accepts no responsibility for any losses arising there from. The price of any Goods will be as quoted on the website from time to time; however whilst we will try to ensure that all prices are accurate, errors may occur. Should this happen we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. Prices will only be valid at the time they are quoted. Prices are liable to change at any time, but changes will not affect orders in respect of which an Order Confirmation has been issued. If a delivery address is changed there may be a different delivery charge applied to the order.
Contract:
The Contract represents the whole agreement between the Company and the Customer and no other terms, expressed in writing or orally, shall be incorporated into the Contract. No contract shall subsist between the Company and the Customer until the Company accepts by e-mail the Customer’s order. Acceptance of an order will be deemed complete and effectively communicated to the Customer at the time the Company sends an acceptance e-mail to the Customer. All descriptions and illustrations contained in this web site or any price list or other information communicated to the Customer are intended merely to present a general idea of the Goods, and do not form any part of the contract between the Company and the Customer.
Technical Information:
The Customer acknowledges and agrees that copyright in all drawings, illustrations, designs, specifications, and other information provided by the Company in connection with any quotation, contract or otherwise remains with the Company. The Customer further acknowledges and agrees the details and contents of the drawings, illustrations, designs, specifications and other information shall remain confidential between the Company and the Customer.
Payment:
The Goods shall be paid for in full prior to delivery and/or commencement of work by the Company. Payment shall be made in Indian Rupees or such currency as may be agreed by the Parties. If the customer cancel the agreement within 24 hours after confirmation of the product, 5% of the advance amount will be deducted and the balance amount will be paid to the party within 10 working days.(It is possible only if production work is not started in the company while cancelling the agremeent)
Delivery:
Any time(s) and date(s) specified for delivery of the Goods shall be treated as estimates only. Time shall not be of the essence of the Contract, nor may be made so. The Company shall not be liable for any indirect or consequential loss (both of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay or failure in the delivery of the Goods (even if caused by the Company’s negligence or deliberate breach). Free Delivery of the goods within 50 kilometres from company to the delivery point. Market charges will apply for transportation after free delivery. (A minimum order value of 20,000/- may be applied for free transportation of product.)
Company Liability:
The Company’s total liability in contract, tort (including negligence, deliberate breach or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the Contract shall be limited to the Price; and ii. the Company shall not be liable to the Customer for: (a) loss of income or revenue; (b) loss of profit; (c) loss of business; or (d) depletion of goodwill in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused and even if caused by the Company’s negligence or deliberate breach) which arise out of or in connection with the Contract.
Notices:
All notices given by the Customer to the Company must be given to Greenhopper Machineries & Contractors Pvt Ltd, SIDCO Industrial Estate, Kallettumkara, Thrissur, Kerala. The Company may give notice to the Customer at either the e-mail or postal address the Customer provided when placing an order. Notice will be deemed received and properly served immediately when posted on the Company’s website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail that such e-mail was sent to the specified e-mail address of the addresses
Lien:
The Customer hereby acknowledges the Company has a lien over all goods in its possession belonging to the Company to secure payment of any or all amount.
Warranty:
All warranties, whether expressed or implied and whether statutory or otherwise with regard to the goods supplied by the company as to quality, fitness for the purpose or any other matter, are hereby excluded, except insofar as any such warranties are incapable of exclusion at law.
Checkout Procedure:
Online purchase of products from Green Hopper Pvt Ltd is restricted to shipping addresses within the Kerala state of India.
While purchasing any of the products from Green Hopper Pvt Ltd through online portal in company website customer have to make the full payment of the product initially while placing the order.
Once the company receives the payment Company will inform the production time to the customer. Production time will be usually 15 to 20 days (depending on the product).
After completing the production work company will contact the customer with photos of completed work. (When customer receives these details of completed work customer can visit the company to check the quality of work if required.) After the customer is convinced with product, company will proceed to the shipping of product.
Within 3 days after completing the production work and sending the details of completed work to the customer, product will be send to customer in a cargo or transport service. Customer can suggest which transport or cargo service should be used.
Details of parcel and LR copy from cargo or transport service will be sending to customer by mail and whatsapp
Company will confirm whether the customer received the parcel. Company will also ensure the quality of product received to customer. This is the system followed by Green Hopper Pvt Ltd.
After completing above steps company will close the file considering the procedures are over.
Shipping:
Shipping of the product will be done within 18 to 23 days after placing the order by making the full payment of product.
15 to 20 days will be taken for production work after placing the order
After completing the production work company will contact the customer with photos of completed work. (When the customer receives these details of completed work customer can visit the company to check the quality of work if required.) After the customer is convinced with product company will proceed to the shipping of the product.
Within 3 days after completing the production work and sending the details of completed work to the customer, product will be send to customer in a cargo or transport service. Customer can suggest which transport or cargo service should be used.

Variations:
The Company reserves the right to vary these Terms and Conditions of Sale from time to time at its discretion.
